Comfic- Court Experience
As part of my coursework I had to attend and present my case to a mock court. Although not a real court, the nerves were still present.
I had to do the following as part of the court process:
- Summarise my findings
- Give answers to questions asked by both the prosecution and device
- Dress appropriately
- Explain
Although sounding simple, I found it was very easy to get tangled up.
Below are a tips I found useful:
- Court is based heavily upon your report, do not stray from it or tell lies
- Unless you have CCTV evidence and other things, nothing is absolute
- Terms such as possibility and probability will be used
- You must be able prepare to simplify and explain things for the courts
Example:
You mention defendant had a virus on the computer, explain to the jury what a virus is?
Can you be certain that the defendant was the one who was logged in?
Now this was a question I actually got.
I had the following evidence available to me:
registry data showing the full name
intelligence from police linking this to suspect
log in times and count showing multiple logins and one before seizure
my answer was as follows:
The evidence from the registry showed the full name to be that of the one intelligence linked to the suspect. The number of times logged and the most recent login would indicate there is a high probability that the account belongs to the suspect.
